What is a Trespass Enforcement Authorization?
This is a document that allows the City of Fairmont Police Department to enforce trespassing laws on your business's property during and outside of your normal hours of operation.
Businesses and entities that complete this form are added to a running list that is distributed to our officers. The form also obligates the signer, or their designee, to cooperate fully in the prosecution of anyone who is arrested for any applicable violation.
This form directly allows officers to enforce Fairmont City Code Section 533.02 TRESPASS. It is standard procedure that officers will ask any individual found in violation to leave the premises then if the individual refuses to vacate the premises, the officers will enforce the code section listed above, including applicable penalties. Our Police Officers are committed to compassion and empathy and will only cite individuals if they refuse to leave. However, they will take action if the individuals are combative or uncooperative.
